ОЦЕНКА ГРАЖДАНАМИ ВЛИЯНИЯ КОНТРОЛЬНО-НАДЗОРНЫХ ОРГАНОВ НА ОБЕСПЕЧЕНИЕ И ПОВЫШЕНИЕ ЗАЩИЩЕННОСТИ ОХРАНЯЕМЫХ ЗАКОНОМ ЦЕННОСТЕЙ
Аннотация
Одной из ключевых задач российского государства является обеспечение и повышение защищенности значимых для граждан охраняемых законом ценностей (далее – ОЗЦ) – жизни и здоровья людей, имущества и проч. – от рисков причинения им вреда (ущерба). Успех решения этой задачи во многом зависит от того, насколько системно выявляется и учитывается мнение граждан о влиянии на этот процесс контрольно-надзорных органов (далее – КНО). Прежде всего – относительно полученного результата их обращений в КНО в целях обеспечения защиты ОЗЦ. В качестве метода исследования проблемы предложен соцопрос граждан. С этой целью с участием авторов в инструментарий проводимого ежегодно с 2018 г. общероссийского соцопроса РАНХиГС относительно оценок гражданами уровня защищенности ОЗЦ были также включены вопросы, выявляющие то, как граждане оценивают влияние КНО на обеспечение и повышение защищенности ОЗЦ. Результаты анализа ответов на эти вопросы в соцопросе РАНХиГС в 2025 г. подтвердили сохраняющуюся актуальность исследования: 37,3% граждан за два года, предшествующие опросу, сталкивались со случаями рисков причинения или причинением вреда (ущерба) ОЗЦ. Исследование показало, что положительные итоги обращений в КНО за защитой ОЗЦ от контролируемых государством рисков причинения им вреда побуждают граждан к более высоким оценкам защищенности ОЗЦ. Более половины респондентов к необходимым мерам по повышению защищенности ОЗЦ относят повышение доступности и качества своего взаимодействия с КНО. Из этого следует, что забота о росте доли обращений граждан в контрольно-надзорные органы за помощью в защите охраняемых законом ценностей и той части из обращений, по которым заявителем получен полностью положительный результат, может рассматриваться как одна из ключевых мер повышения защищенности ОЗЦ. Ее целесообразно включить в качестве таковой в стратегические документы по совершенствованию государственного контроля (надзора) – при их обновлении.
